The undersigned (“I” or “Participant”) hereby (i) authorizes Wesleyan Investment Foundation, Inc., an Indiana not-for-profit corporation (the “Foundation”), acting through its agents, employees, or representatives, to take photographs, video recordings, audio recordings, or any other recording of me by conventional, digital means or by any other technology now known or developed in the future (the “Recordings”), (ii) grants the Foundation an unlimited, absolute, perpetual, royalty-free, world-wide, and irrevocable right and permission to use, broadcast, publish, copy, distribute, incorporate, transfer, and assign the Recordings, voice, photograph, likeness, distinctive appearance, gestures, and mannerisms (the “Persona”) for promotion, trade, or any other lawful purpose; (iii) waives all right, title, and interest Participant may have currently or in the future in the Recordings, any Persona appearing in the Recordings, and any derivatives thereof in print, digital, or any other form (collectively, the “Persona IP”); (iv) waives all right, title, and interest to inspect or pre-approve the Persona IP or the manner in which the Persona IP is used by the Foundation; (v) waives any present or future right, title, and interest to payment or compensation for the Persona IP, and (vi) understands and consents that any intellectual property rights, including, but not limited to, copyright, in the Persona IP is solely owned by Foundation.

I release and fully discharge the Foundation and its agents, employees, officers, directors, assignees, and representatives from any and all claims, damages, liability, and causes of action for libel, infringement of any copyright or any other intellectual property rights, infringement of the right of publicity, invasion of privacy, portrayal in a false light, or any other claim arising from the use of the Persona IP, including but not limited to, any causes of action pursuant to FL ST § 540.08, IN ST. § 32-36-1-1 and any other applicable state and/or federal laws.

I am eighteen (18) years of age and have read this release form and fully understand and agree to its contents. I have not been induced or coerced in any way into signing this agreement. If I am legally under age, my undersigned parent(s) or legal guardian(s) hereby consents, jointly and severally, to the terms contained herein and agrees to indemnify and hold the Foundation harmless against any claim of mine or of my heirs, executors, administrators, or assignees, arising hereunder that may hereafter be asserted against the Foundation.
